MyMonashMoments 2012 Contest

Terms and Conditions

1. Information on how to enter the MyMonashMoments 2012, a short-film contest (Contest) and prize details of the Contest shall form part of these terms and conditions of entry (Terms).

2. The promoter is Monash University Sunway Campus Malaysia Sdn Bhd (Co. No. 458601-U), represented by the Marketing Office in the Advancement Unit 

.

3. The Contest Eligibility:

a. Only students who are enrolled and pursuing a course with Monash University Sunway Campus are eligible to participate in the Contest ("the Participant"). Employee (permanent, contractual, temporary or otherwise), management, and contractors of Monash, and companies associated with this Contest, and their immediate families are excluded from participating in the Contest.

b. Participants aged 18 years of age and below, must obtain prior consent from their respective parents or legal guardians.

4. Participants can either submit their entry individually or as a group. Only one entry is allowed per Participant/Group.

5. This is a game of skill, and chance plays no part in determining the winners. No entry fee is required to enter this Contest.

.

6. The Contest commences at 10.00a.m. on Monday, 1 May 2012 and runs until 11.59p.m. on Thursday, 31 May 2012 or any other duration specified by Monash (Contest Period).

.

7. Participants must upload the videos at www.monash.edu.my/moments in order to participate in this Contest.

.

8. All complying entries will be made public and can be viewed at the Monash University Sunway Campus YouTubeTM Channel.

.

9. If a Participant's contact details change during the Contest Period, it is the Participant's responsibility to notify Monash in writing. 10. All entries become the property of Monash and will not be returned to the Participant.

11. Contest Mechanics are as follows:

.

a. Step 1: Attend a Film-making Workshop hosted by Jin Lim from jinnyboytv

Date : 25 April 2012

Time : 12.00noon

Venue : Plenary Theatre.

This workshop would showcase jinnyboytv shortfilms and videos as well as cover the following topics;

• Independent filmmaking production process

• Filming on a budget

• Writing interesting scripts

• Choosing your actors

• Shooting

• Post Production

b. Step 2: Minute your Moment

Once you are inspired, get filming! All short-films must be original, must be a maximum of 3.00 minutes long and must comply with all YouTube™ and legal requirements and guidelines.

c. Step 3: Submit your short-film

All short-films must be submitted to www.monash.edu.my/moments by 11.59pm on May 31, 2012. Monash will then upload the short-films onto the Monash YouTube™ channel. Participants will receive a notification via their registed email once their short-film has been uploaded.

d. Final Selection (Judging Criteria):

A panel of judges consisting of Jin Lim, Reuben Kang of jinnyboytv and selected members of the campus will determine the award winners based on originality, creativity, clear expression of ideas and production value.

12. Entry Criteria

To be eligible for the Contest, submissions must:

a. be original works, produced specifically for this Contest;

b. be in the English Language OR have English subtitles.

c. include a title;

d. not contain any material which might infringe the intellectual property rights or any other rights of third parties;

e. be in digital format;

f. not include explicit material such as harsh/coarse/abusive language, alcohol, drugs, sex, nudity or violence and other subjects as outlined in the Prohibited Student Activities Guidelines;

g. not contain the name, image, likeness or voice of any person (including the Participant) unless that person (and, if any other person is under 18 years of age, their parent or guardian) has signed the Consent Form provided herein

.

13. Films may be taken using a range of equipment (including without limitation telephones, digital cameras, SLR/D-SLR cameras and Polaroid cameras). Participants must keep the original file for the submission entered, and Participants selected as winners must, if requested, provide the relevant file to Monash as evidence of authorship.

.

14. Incomplete, illegible, indecipherable and late applications are invalid. Monash accepts no responsibility for late entries or entries not received for any reason.

.

15. Monash reserves the right to disqualify any entries in its absolute discretion. For example (without limitation), Monash may disqualify:

a. any Participants or entries that tamper with, or attempt to tamper with the entry process;

b. incomplete, indecipherable or illegible entries, or entries containing false information or incorrect contact details;

c. any entries that contain material that is obscene, indecent, objectionable, defamatory, libellous or otherwise contravenes an applicable law or infringes any third party's rights; and

d. any entries that Monash, in its absolute and sole discretion, considers inappropriate for any reason. Monash reserves the right to withhold the prizes aforementioned at Monash's sole and absolute discretion should there be any fraud cases detected before the prizes are given to the winners. Fraud in this context includes, without limitations, participating in the contest on two or more computers/browsers at the same time, artificial score modification or using third party software of any kind.

16. By entering, Participants:

a. confirm that the content of their entry is original and does not infringe the intellectual property rights or any other rights of third parties;

b. grant Monash a perpetual, royalty-free, irrevocable, worldwide, non-exclusive licence (with the right to sub-licence) to use, reproduce, modify, adapt, screen in public, communicate to the public, and otherwise exploit the film entered by the Participant (including the title and description) in any media (whether known now or developed in the future), for any purpose (including to advertise or promote any of the Contest, Monash and Monash's products and services);

c. consent to any act or omission by Monash that would otherwise infringe any moral rights that may subsist in their entry;

d. agree to the use of their entry (in whole, edited or altered form) and the Participant's name for the purpose of promoting any of this Contest, Monash and any of Monash's products or services in any media worldwide.

e. Each Participant and/or winner hereby irrevocably agree, authorise and give consent to Monash to use the information or publish (without geographical limitations) any related matter to the entries including and not limited to the Participant and/or winners' names, interviews and photographs for current and future advertising and promotional purposes.

17. By submitting the Participants' film to Monash, the Participants are authorising and allowing Monash

a. to promote the Participants' film and make them available for viewing where Monash deems fit, and for a reasonable period after submission,

b. to use film stills and other images from the Participants' submission and/or their name, image, likeness, character, voice or anything else that identifies them on Monash's website, on other press materials, and in any media worldwide, including print materials, without remuneration, in the promotion of Monash, the MyMonashMoments 2012 Contest, present and future, and any of Monash's products or services; and

c. agree to sign any further documentation required by Monash to give effect to this clause.

18. Contest prizes

a. Prizes are for the winner, runner-up and second runner-up:

Winner RM 3000 cash & certificate of participation

Runner-up RM 2000 cash & certificate of participation

Second runner-up RM 1000 cash & certificate of participation

b. Any additional cost associated with prize fulfillment is the sole responsibility of the winner.

c. The prizes are subject to availability and may be changed from time to time at Monash's discretion without prior notice to Participants.

d. Monash reserves the absolute right to substitute any prize in whole or in part for something of approximately equivalent value if the prize or any component of the prize is unavailable.

e. Prizes are not transferable, deferrable, exchangeable or redeemable for product.

f. In the event a winner is found to be ineligible at any point of time during or after the Contest Period, Monash reserves the right to disqualify the said winner and to cancel/ withdraw/ recall the prize(s) from being delivered to the ineligible winner. If the winner has enjoyed the prize(s), the ineligible winner hereby agrees and undertakes to indemnify Monash for the cost of the prize(s), failing which, Monash shall have the right to initiate any action it deems necessary against the ineligible winner.

19. Notification and selection of Contest Winners

a. The winners will be announced on June 9 and an award ceremony will be organised on a later date.

b. The winners will be contacted by Monash via email and Facebook on June 7 – 8, 2012 or other period as determined and stipulated by Monash.

c. Each Participant must ensure that he/she is contactable at any time by Monash, until such time the prize is given to the winner. In the event Monash is unable to contact a particular winner after three (3) attempts per winner during the same day, an email will be sent to them to inform them to contact Monash at the end of the day.

d. The Participant winner is given two (2) days to respond to the e-mail, after which the prize(s) will be offered to the next winner or forfeited.

e. Monash will use all reasonable efforts to contact a Participant selected as winner as stated above, but accepts no responsibility if a Participant cannot be contacted. A Participant who cannot be contacted as aforesaid will forfeit the prize in its entirety and shall have no claims whatsoever against Monash on the cancellation and the forfeiture.

f. The winner must collect the prize(s) at the date and location determined by Monash.

g. All decisions by Monash, including but not limited to the selection of winners and forfeiture of prizes are final, conclusive and binding. No correspondence or claims will be entertained. The selection of the winners shall be at Monash's sole and absolute discretion.

h. Monash may at its sole and absolute discretion award any prize(s) forfeited for whatever reason(s), to the next winner.

20. Monash does not warrant that the Contest shall be uninterruptible and/or error free. By participating in the Contest, the Participants hereby acknowledge and irrevocably agree that Monash shall not in any manner be liable for any interruption, error and/or otherwise arising from the Contest.

a. Monash reserves the right to alter, cancel, terminate or suspend the Contest or any part thereof with or without any prior notice.

b. For the avoidance of doubt, the alteration, cancellation, termination or suspension by Monash of the Contest or any part thereof shall not entitle the Participant/winners to any claim or compensation against Monash (in cash or in kind) for any and all loss, cost or damage suffered or incurred by the Participants as a direct or indirect result of the act of alteration, cancellation, termination, suspension or otherwise.

c. Monash reserves the right at its absolute discretion to vary, delete or add to any of the mechanics, prizes or these Terms from time to time without prior notice.

d. If for any reason this Contest is not capable of running as planned, including as a result of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Monash which corrupt or affect the administration, security, fairness, integrity, safety or proper conduct of this Contest, Monash reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest, subject to any applicable legislation.

21. Privacy Statement.

Participants' personal information is collected by Monash, and may be disclosed to Monash's contractors and agents (including without limitation marketing and promotional agencies, information technology providers and database service providers) to conduct, administer and publicise this Contest. If the Participant's submission or associated title contains personal information about the Participant, the Participant agrees to the use and disclosure of that personal information as set out in these Terms and the Participant Talent Release Form (which the Participant must sign). If a Participant does not provide the personal information requested in the entry form, they will not be able to enter the Contest. If inaccurate or incomplete personal information is provided, Monash may determine that the Participant is ineligible to win a prize. Participants can request access to their personal information by contacting the Marketing Office of the Advancement Unit.

22. Disclaimers

a. Monash shall not be responsible or liable for any claims, loss or damage (including without limitation loss or damage to property, any personal injury, loss of life, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Contest or the prizes given under this Contest, even if Monash has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.

b. Monash, and its respective parent companies, subsidiaries, affiliates, licensees, directors, officers, employees, agents, independent contractors and advertising/Contest agencies make no warranties, express or implied, in fact or in law, relative to the use or enjoyment of any of the prizes, including, without limitation to, their quality, merchantability or fitness for a particular purpose. To the fullest extent permitted by law, Monash hereby expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of the prizes.

c. None of Monash, its related bodies corporate or any of their employees, contractors and agents (or employees of their contractors and agents) will be liable for any liability, loss, damage or expense (including but not limited to direct, indirect or consequential loss, loss of profits, death or personal injury), suffered or incurred (whether or not arising from any person's negligence) arising out of, or in connection with, this promotion, the provision of the prizes, use or participation in the prizes or marketing of this promotion, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

d. Monash and its respective parent companies, affiliates, subsidiaries, licensees, directors, officers, agents, independent contractors, advertising, Contest, and fulfilment agencies, and legal advisors are not responsible for and shall not be liable for: (a) telephone, electronic, hardware or software program, network, internet, server or computer malfunctions, failures, interruptions, miscommunications or difficulties of any kind, whether human, mechanical or electrical, including, without limitation to, the incorrect or inaccurate capture of entry information online; (b) late, lost, delayed, misdirected, incomplete, illegible or unintelligible e-mails and/or submissions; (c) failed, incomplete, lost, garbled, jumbled, interrupted, unavailable or delayed computer transmissions; (d) any condition caused by events beyond the control of Monash that may cause the Contest to be disrupted or corrupted; (e) any injuries, losses, or damages of any kind arising in connection with or as a result of the prizes, or acceptance, possession, or use of the prizes, or from participation in the Contest; or (f) any printing or typographical errors in any materials associated with the Contest; (g) any claims by third party for infringement of intellectual property rights.

23. Any failure by Monash to enforce any of these Terms in any instance(s) will not give rise to any claim by any person, and shall not be construed as a waiver of or prejudice Monash's rights herein contained.

24. By participating in the Contest,:

a. each Participant shall be deemed to have unconditionally accepted the all the terms and conditions of this Contest and the Participant further

i. agrees to co-operate and comply with all reasonable requests of Monash in connection with the Contest;

ii. agrees to disclose personal details to Monash for the purpose of organising, promoting and conducting the Contest; and

iii. consent to receiving promotional, marketing and other publicity information from Monash from time to time;

b. the Participant and/or the prize recipient hereby agree and irrevocably and unconditionally undertake to fully absolve Monash of any and all liabilities, and agree to indemnify Monash (on full indemnity basis) and hold Monash harmless against any claim by any third party and/or against any loss, damage, cost or expense (including but not limited to indirect or consequential loss, and solicitors' fees and cost on solicitor-client basis) that Monash may suffer or incur as a result of or howsoever caused by the acts or omission of the Participant (including but not limited to the Participant acting inconsistently with or breaching any part of these Terms), or in connection with the entries submitted, the Contest and/or the prizes;

c. each Participant (or the Participant's parent/legal guardian if the Participant is a minor below 18 years of age) agrees to release and hold Monash, and its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, licensees, advertising, Contest, fulfilment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest or resulting from acceptance, possession, use or misuse of any prize, or travel to or from any prize -related activity, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; and

d. Participants acknowledge that they have read and understood the terms and conditions of this Contest and agree to be bound by them.

25. Monash's decision on all aspects relating to this Contest is final and binding, and no correspondence will be entered into.
