Across the Causeway, Reform Begins

The evolving landscape of commerce and law necessitates a proactive approach to foundational legal reform. In this spirit, a significant two-day hybrid roundtable titled "Contract Law Reform Across the Causeway: A Roundtable Discussion Workshop on Revising Malaysia's Contracts Act 1950" was held on 27 and 28 June 2025. Hosted by the Barker Centre for Law and Business at the National University of Singapore (NUS) Faculty of Law, the event was jointly organised by the Centre for Commercial Law and Regulatory Studies – Malaysia Hub (CLARS-MH), School of Business at Monash University Malaysia, with the Legal Affairs Division of the Prime Minister's Department (BHEUU), and Universiti Kebangsaan Malaysia (UKM) Pakarunding—demonstrating a strong collective commitment to legal advancement.

The roundtable provided a platform for eight specialised panels to present and discuss proposed reforms to the Contracts Act 1950 with a diverse and informed audience. This open exchange offered participants valuable insight into the rationale behind the legal updates and the potential direction of Malaysia’s future contract law framework. The sessions also allowed the presenters to benchmark their proposals against comparative approaches from other jurisdictions and refine their recommendations based on constructive feedback.

Recognising the need to modernise the Contracts Act 1950 to meet current legal standards and societal demands, the reform initiative is led by a Working Group of senior judges, legal academics, and practitioners. With implications extending across the ASEAN region’s transnational commercial landscape, the initiative aims to harmonise Malaysia’s contract law with international best practices. These efforts support the broader goal of aligning business laws among ASEAN member states, advancing the vision of a unified economic community. The roundtable embodied this goal by encouraging critical discussion and collaborative exploration of tangible legal improvements.

A highlight of the event was the keynote address delivered by Mr Chan Sek Keong, former Chief Justice of Singapore, titled "Their Law in Our Hands – the Application of English Law by the Singapore Courts." His remarks offered deep insights into judicial interpretation and the application of inherited legal principles. The address was followed by an engaging discussion chaired by Emeritus Professor Tan Lee Meng of the NUS Faculty of Law.

The roundtable’s significance was underscored by the presence of key figures from the Malaysian Committee for the Review and Reform of Contract Law (CRRCL), including  YA Justice Datuk Vazeer Alam bin Mydin Meera (Federal Court, Committee Chairperson), Justice Dato’ Mary Lim Thiam Suan (Former Federal Court Judge and Director of the Asian International Arbitration Centre), and Dr Punitha Silivarajoo (Deputy Director General, Policy & Development, Legal Affairs Division, Prime Minister’s Department). Professor Tan Cheng Han, Chief Strategy Officer and former Dean of the NUS Faculty of Law, also shared his expertise throughout the event. The workshop was graciously hosted by Associate Professor Burton Ong, with its smooth execution made possible by the leadership of Associate Professor Adnan Trakic, Director of CLARS-MH and Project Leader of the Contract Law Reform, along with his team members, Ms Lai Woon Fui and Anisah Norman.

The discussions clearly underscored the urgency of updating Malaysia’s contract law to reflect contemporary needs, promote regional legal coherence, and enhance clarity and effectiveness.

By facilitating rigorous dialogue and collaborative exchange, the roundtable not only highlighted the importance of revising foundational legislation but also affirmed the collective resolve to build a more responsive and future-ready legal framework for Malaysia and the wider ASEAN region. The insights and connections forged during the event will undoubtedly serve as a catalyst in advancing this vital reform agenda.
